Under the provisions of the Family Educational Rights and Privacy Act, as amended by the Campus Sex Crimes Prevention Act, Southern Arkansas University will disclose information concerning registered sex offenders.
The Campus Sex Crimes Prevention Act (section 1601) {(42 U.S.C., 14071j and 20 U.S.C., 1092 (f) (1) (1)} is a federal law enacted on October 29, 2000. This law is intended to monitor the enrollment and/or employment status of convicted sex offenders at higher education institutions. The purpose of this reporting is to ensure that members of the campus community have information available concerning the presence of registered sex offenders.
Any person who is required to register as a sex offender in Arkansas shall provide notice as required under state law. The offender is required to report such information concerning registered sex offender’s enrollment or employment and to make this information available promptly to the Southern Arkansas University Police Department.
The Campus Sex Crimes Prevention Act also requires that higher education institutions issue a statement advising the campus community of the availability of this information. Arkansas Code Annotated 12-12-913 (b) provides that local law enforcement agencies having jurisdiction shall disclose, in accordance with guidelines promulgated by the Arkansas Sex Offenders Assessment Committee, relevant and necessary information regarding offenders to the public when the disclosure is relevant and necessary for public protection.

Level 2 – Moderate Risk Offender
Level 3 – High Risk Offender
Level 4 – Sexually Violent Predator
